The officer may administer tests to you to determine if you are impared or not. These tests are voluntary, and you may refuse them with no loss of rights. Tests vary across Ohio, but include:

  • Horizontal Gaze Nystagmus (HGN)
  • Standard Field Coordination Test, commonly called a Field Sobriety Test (FST)
  • Portable Breath Test (PBT)

If the officer judges that you are too drunk to drive he may arrest you and take you to a police station. Once there, the officer will administer a Formal Breath Test (FBT), which you are required by Ohio law to take, to see if your blood alcohol level exceeds 0.08%. If you choose not to take the test, your license will automatically be suspended for at least 1 year. If you take the test and fail, your license will be automatically suspended, and you will be charged with DUI / OVI.
